Since any rights you have as a parent are built upon the actual fact of your parenthood, establishing your parenthood is of the utmost importance in asserting your parental rights. For mothers, this is usually not a problem.

For fathers, however, this can be a much more complicated matter. When a child is born within the context of marriage, legal paternity is presumed unless it is challenged. Establishing paternity: Both parents can acknowledge paternity or one of the parties petitions the court for a paternity action.
