What Are the Important Questions to Ask Your Divorce Lawyer?

At the Washington State divorce & family law firm of Akiona Law, we know this is a tough time for couples. As a result of the COVID-19 pandemic, married couples have been stuck together in the home for months postponing major life decisions, such as filing for a divorce. As Washington State moves toward a statewide reopening, even though money might be tight, unhappy married couples are finally taking the first step and talking to a Washington divorce lawyer.

There are many common questions that people ask a divorce lawyer at the initial consultation: “How long does it take to get a divorce in Washington State?” “How do I get custody of my child?” “How is Washington State child support calculated?” “How much spousal support (alimony) will I get?” “How much spousal support (alimony) will I have to pay?” “Can my wife take my retirement or pension in a divorce?” “Do I get half of my husband’s 401k in a divorce?” While these questions are essential, many law firms are all too happy to tell you what you want to hear so you hire them to represent you in your divorce.

Here is an important question people should ask their potential divorce or family law attorney but do not: “What is your approach to divorce or family law cases?” If they seem confused, you can clarify: “Do you have a one-size-fits-all approach, or do you come up with an individualized Case Plan based on the facts and circumstances of my situation?”

Beware of divorce attorneys who take a standardized, one-size-fits-all approach to your situation! Yes, they understand how the divorce process works…and they drop your case into it, like dropping coins into a piggy bank. But, in a contested divorce case, those puzzle pieces do not fall neatly into place as there is no one-size-fits-all solution. Since every single divorce and family law case is different, shouldn’t they all have different processes and different outcomes? Yes, they should! This is what separates the best from the rest: a good divorce lawyer will come up with a unique Case Plan tailored to your particular facts and circumstances.

Akiona Law’s Case Plan is a suggested series of actions or steps to help you move towards your desired goals in your divorce or family law case. A Case Plan is a unique process we developed at Akiona Law based on our belief there is no “one-size-fits-all” approach. We personalize the Case Plan to meet the specific circumstances of your divorce or family law matter.
