As we’ve noted, such agreements are becoming more popular among couples, but it is important for parties to such an agreement to be well represented to ensure they are not disadvantaged by coercion or unfair terms.

Last time, we began looking at the increasing popularity and potential uses for postnuptial agreements. As we noted, marital agreements—those negotiated once a couple has contracted a marriage—can be a useful tool for protecting assets in the event of divorce or upon death. In negotiating any marital agreement, though, working with an experienced attorney is imperative.

The prospect of splitting up property in divorce is a stressful reality for many couples, particularly those who have significant assets to lose in divorce. ‘American Pie’ singer waives prenuptial agreement rights in divorce settlement

Last month, Don McLean of ‘American Pie’ fame reached a settlement with his wife of 30 years, Patrisha McLean. McLean’s wife filed for divorce back in March after an incident which led to his arrest and subsequent domestic violence charges. In her divorce filing, Patrisha McLean cited “adultery, cruel and abusive treatment, and irreconcilable differences.”
